Berdasarkan data yang dihimpun dari Lembaga Pemasyarakatan (Lapas) Kelas II-A Balikpapan, dari 697 narapidana (napi) yang ada di sana, tercatat ada 150 orang diantaranya yang merupakan pelaku kejahatan seksual terhadap anak. Jumlah tersebut terus mengalami peningkatan dari tahun sebelumnya, di mana hanya ada 120 napi yang dihukum atas tindak pidana kejahatan seksual ini (selengkapnya lihat grafis).
Napi yang meringkuk di penjara itu kebanyakan berasal dari Balikpapan. Selebihnya dari kabupaten tetangga, seperti Penajam Paser Utara (PPU), Paser, hingga Kutai Kartanegara (Kukar). “Limapuluh persen adalah orang Balikpapan, karena di sini (Lapas Balikpapan) adalah lapas rujukan yang ada di Kaltim,” kata Kepala Lapas (Kalapas) Balikpapan, Edy Hardoyo, kemarin.
Vonis yang dijalani oleh pelaku kejahatan seksual terhadap anak itu juga beragam. Mulai dari 5 hingga 10 tahun penjara. Berdasarkan hasil pendekatan persuasif yang dilakukan petugas lapas terhadap para napi kejahatan asusila, terungkap alasan tindakan itu dilakukan. Yakni, karena pelaku tidak mampu melampiaskan hasrat seksualnya. “Kalau untuk orang yang tua, kebanyakan karena ditinggal istri. Kalau untuk yang remaja dan anak mudanya, karena pergaulan. Mereka tidak ada pelampiasan seks,” terang pria yang sebelumnya menjabat sebagai kalapas Tarakan itu.
Saat ini para napi kejahatan seksual anak itu dicampur dengan napi pidana umum lainnya. Di blok C untuk napi di bawah 50 tahun, dan blok D untuk napi di atas 50 tahun. Pembinaan pun juga disamakan dengan napi tindak pidana umum lainnya,seperti mengikuti kegiatan keagamaan dan jasmani.
Lain lagi di Rumah Tahanan (Rutan) Kelas II-B Balikpapan. Tetangga Lapas Balikpapan ini menampung setidaknya 14 orang pelaku kasus kejahatan seksual terhadap anak. Dari total 750 warga binaan yang ada di sana, 11 diantaranya berstatus napi dan tiga lainnya masih berstatus tahanan yang menunggu hukuman.
Jumlah pelaku asusila anak yang ada di Rutan Balikpapan ini jumlahnya tak sebanyak di Lapas Balikpapan. Ini karena setelah tahanan mendapatkan putusan pengadilan, maka akan diserahkan ke lapas untuk menjalani hukuman. “Setelah diputus (pengadilan) memang kami serahkan ke lapas. Karena kondisi Lapas sekarang overkapasitas, makanya masih ada 11 napi yang sudah diputus berada di sini (Rutan),” kata Kepala Sub Seksi Pelayanan Tahanan (Kasubsi Yantan) Rutan Balikpapan, Sumaryo saat ditemui Balikpapan Pos, kemarin.
Putusan napi yang menjalani masa hukuman di Rutan Balikpapan pun beragam. Paling cepat mereka mendekam di penjara lima tahun, paling lama 12 tahun. Para napi yang mendapat hukuman lima tahun itu, menurut Maryo, sebelum terbitnya revisi Undang-Undang Perlindungan Anak, Undang-Undang Nomor 35 Tahun 2014. Para napi tersebut masih didakwa dengan Undang-Undang Perlindungan Anak yang lama, yakni Undang-Undang Nomor 23 Tahun 2002. “Kalau undang-undang yang baru (UU 35/2014), pasti didakwa minimal delapan tahun,” ungkap dia.
Para napi dan tahanan yang ada di Rutan Balikpapan, umumnya adalah pelaku yang baru sekali melakukan kejahatan seksual terhadap anak.

Blok Akhusus napi pekerja, blok B khusus tahanan, blok C khusus napi, dan blok D khusus wanita. Kalau kasus kejahatan anak, kami campur juga dengan kasus umum. Kalau dia tahanan, kami tempatkan di blok B. Kalau dia napi, kami tempatkan di blok C,” kata Maryo.
Begitupun dengan pembinaan. Napi maupun tahanan tersebut juga disamakan, sesuai dengan minat dan kemampuan. “Tak ada yang dibedakan. Kalau dia suka untuk pertamanan, kami arahkan dia untuk merawat taman. Contohnya Johny Rumengan.
